Terms and conditions

The Inclusive Wayfinding Toolkit is free to download. These terms define the conditions for its use for specific purposes in the UK, and how the toolkit can be shared with others via this website download.

You are permitted to use these guidelines and downloaded elements royalty-free for the purposes of better signing environments to increase levels of walking, wheeling and cycling.

You are permitted to reproduce extracts and documents by way of printing, downloading to a drive and by distribution to other people within your organisation only. Please share within your organisation using the download link. This is available to everyone.

The guidelines and resources are not for resale. No reproduction of any part of the Toolkit may be sold, re-sold or distributed for commercial gain nor shall it be incorporated in any other publication, whether in hard copy or electronic format, including posting to any other website, without the express written permission from Applied Information Group. No other licence or right is granted.

All copyright and other intellectual property rights in all text, images, sound, software and other materials in this Toolkit are owned by Applied Information Group or the original copyright owners. The Toolkit is for information only. The authors are not responsible for how the guidelines are implemented or their effect.

Full terms and conditions of use

Grant of licence

Upon download of the Toolkit, Applied Information Group grants you a non-exclusive, terminable and non-transferable licence to use the Inclusive Wayfinding Toolkit in accordance with the following terms and conditions. You may not exceed the scope of this licence. If you have negotiated and agreed to any additional terms and conditions, those must be agreed in writing with Applied Information Group and must incorporate this Agreement by reference.

Use of the Download is limited to Personal or Internal Business Use only and shall not be distributed (whether compensated or uncompensated) for commercial gain.

Ownership

Applied Information Group retains intellectual property rights, title and ownership of the Inclusive Wayfinding Toolkit. This title and ownership extends to copies of the data installed on any computer, downloaded to any output device, or retained on other media by you as a backup. This licence does not constitute an exclusive sale of the original product to you.

This Agreement does not grant you any right to patents, copyrights, trade secrets, trade names, trademarks (whether registered or unregistered), or any other rights, franchises or licences in respect of the electronic data.

No rights are granted to you other than a licence to use the electronic data on the terms expressly set forth in this Agreement. The Inclusive Wayfinding Toolkit is protected by copyright including without limitation, by English and United States Copyright Law, international treaty provisions, and applicable laws in the jurisdiction of use.

Permitted usage

You are permitted to use these guidelines for the purposes of better signing your environment to support active travel: walking, wheeling and cycling in the UK.

This product is licenced only to your organisation, and may not be transferred to any third party at any time without the prior written consent of Applied Information Group. You may not send or transfer the Inclusive Wayfinding Toolkit, or any copy, to any third party. You may print multiple copies of the guidance, icons and sign designs as required for business use.

No reproduction of any part of the Toolkit may be sold, re-sold or distributed for commercial gain nor shall it be incorporated in any other publication, whether in hard copy or electronic format, including posting to any other website, without express written permission from Applied Information Group.

It is a breach of this licence agreement to use the product in any way that infringes the rights of any third party under copyright, trademark, patent or any other laws. In the event of infringing uses by you, this licence immediately terminates and you are solely responsible for any such infringing uses including all legal and other damages that may be incurred.

You are permitted to reproduce extracts and documents by way of printing, downloading to a hard disk and by distribution to other people within your organisation only. You are permitted to distribute links to the website where third parties can download the Toolkit.

Limited warranty

If the media contained in this Inclusive Wayfinding Toolkit product is found to be defective within 90 days of the date of delivery to you, Applied Information Group will provide suitable replacements at no charge to you, provided you can provide proof of purchase.

Applied Information Group does not warrant that the quality of any material purchased or obtained by you will meet your expectations. This warranty shall only apply as long as:

  • the failure of the Inclusive Wayfinding Toolkit is not a result of any modification other than those made by or on behalf of Applied Information Group;
  • any attempt to rectify the failure has been made by or on your behalf has not been made;
  • the failure is not attributable to causes external to the Inclusive Wayfinding Toolkit; or
  • the Inclusive Wayfinding Toolkit has not been used outside of the parameters granted.

Applied Information Group has made every effort to display as accurately as possible the colours and images of the documents that appear on the website. Applied Information Group cannot guarantee that your computer monitor’s display of any colour will be accurate.

Limitation of liability

Applied Information Group shall not be liable for any loss of profits, goodwill, reputation, business, anticipated savings, contracts, goods, data (or corruption of that data) or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses.

All applications of the Toolkit’s guidance are the responsibility of the implementing authority or party. Applied Information Group shall not be liable for any complaint, accident or damage that could be construed to be caused by guidance from the Toolkit.

Applied Information Group’s liability for all other claims which arise in connection with this Agreement shall be limited to the monies paid by you in the 12 months immediately preceding the date of the event giving rise to the claim.

Termination

Without prejudice to any other rights or remedies which it may have, Applied Information Group may terminate this agreement without liability to you immediately on giving written notice to you if:

  • you commit any remediable material breach of its obligations under this Agreement which is not remedied within 30 days (or where the breach is in relation to a failure to pay any amount due, 7 days) after the service of written notice specifying the breach and requiring it to be remedied; or
  • you commit any non-remediable material breach; or

On termination of this Agreement for any reason:

  • you shall immediately and irretrievably delete the Inclusive Wayfinding Toolkit (including any archived or physical copies) from your systems; and any licence granted shall immediately terminate.
General

You agree to inform your employees or any other person having access to the Inclusive Wayfinding Toolkit and copies thereof, of the terms and conditions and to ensure that they shall strictly abide by these.

Assignment

You may not assign, charge, sub-contract, sub-licence (unless expressly permitted to do so in this Agreement) or otherwise dispose of any of its rights or obligations under this Agreement without Applied Information Group’s prior written consent.

Events beyond reasonable control

Applied Information Group will not be liable for a delay or failure to perform its obligations if the delay or failure results from circumstances beyond its reasonable control. This includes (but is not limited to) dramatic events, flood, fire, accident or impossibility of obtaining materials.
